General Rental Terms and Conditions Domburg Holiday Resort

1. General

1.1. These general terms and conditions apply to all reservations and rental agreements between Domburg Holiday Resort (hereinafter: the landlord) and the tenant of an accommodation or camping pitch (hereinafter: the tenant).
1.2. By making a reservation, the tenant declares to have read and agreed to these terms and conditions.
1.3. Deviations from these terms and conditions are only valid if agreed upon in writing.

2. Reservation and Confirmation

2.1. A reservation becomes binding as soon as Domburg Holiday Resort has confirmed the booking in writing or by email.
2.2. Only persons aged 18 or over may make a reservation.
2.3. Domburg Holiday Resort reserves the right to refuse a reservation without providing reasons.

3. Payment

3.1. A deposit of 40% of the total rental amount must be paid within 7 days of receiving the reservation confirmation.
3.2. The remaining amount must be paid no later than 30 days before arrival.
3.3. For reservations made within 30 days before arrival, the full amount must be paid immediately.
3.4. A surcharge of 4% of the total amount applies to credit card payments.
3.5. In case of late payment, the landlord reserves the right to cancel the reservation, in which case the cancellation conditions (Article 6) apply.

4. Prices and Fees

4.1. The published prices include VAT, tourist tax, final cleaning, and linen packages.
4.2. Domburg Holiday Resort reserves the right to adjust prices if legal levies or taxes change.

5. Arrival and Departure

5.1. The accommodation is available from 3:00 PM on the day of arrival and must be vacated before 10:00 AM on the day of departure (except on Sundays).
5.2. Late arrival or early departure does not entitle the tenant to a refund of (part of) the rental fee.

6. Cancellation by the Tenant

6.1. General

Cancellations must be submitted to the landlord in writing or by email.
The landlord will charge €25 administration costs for each cancellation.

6.2. Cancellation of apartments, studios, and rooms

a. In the event of cancellation, the tenant is not entitled to a refund of the rental amount.
b. Any cleaning fees and tourist taxes already paid will be refunded in full.
c. If the accommodation is re-rented for the original rental period, the landlord will refund the difference between the new rental amount and the originally paid amount to the tenant within 14 days after the original departure date. 

6.3. Cancellation of horse stables

a. Cancellations must be submitted in writing or by email. The landlord charges €25 administration costs for each cancellation.
b. The following conditions apply:

  • Up to 60 days before the arrival date: the deposit is fully refunded, minus €25 administration costs.
  • Up to 30 days before the arrival date: 50% of the deposit is refunded, minus €25 administration costs.
  • Up to 15 days before the arrival date: 50% of the agreed total amount is refunded, minus €25 administration costs, provided the full rental amount has already been received by the landlord.
  • Within 15 days before the arrival date: 25% of the agreed total amount is refunded, minus €25 administration costs, provided the full rental amount has already been received by the landlord.

7. Cancellation by the Landlord

7.1. If the reservation cannot proceed due to circumstances beyond the landlord’s control (e.g., force majeure), the landlord may cancel the reservation.
7.2. In that case, the tenant will receive a full refund of all amounts already paid, without the right to any further compensation.

8. Stay and Use

8.1. The accommodation may only be used by the number of persons specified in the reservation.
8.2. The tenant is required to use the accommodation in a tidy and careful manner.
8.3. It is not permitted to hang objects on or over the balcony railing.
8.4. Smoking is not permitted inside the accommodations (see also Article 9.4).
8.5. Pets are only allowed for an additional fee and if agreed upon and confirmed in advance (see Article 11).
8.6. Nuisance (noise, waste, disruptive behaviour) may result in removal from the premises without a refund.

9. Deposit and Damage

9.1. The landlord may request a deposit of €150 – €300 per accommodation (e.g., for groups).
9.2. The deposit will be refunded no later than 14 days after departure, provided no damage or excessive cleaning costs have been identified.
9.3. The tenant is liable for any damage caused during the stay to the accommodation, inventory, or grounds.
9.4. Smoking inside the accommodation and in or around the stables and hay/straw storage areas is strictly prohibited. If it is established that smoking has taken place (including via smell or tobacco residue), a €500 fine will be charged, regardless of any additional cleaning costs or damage.
9.5. The fine referred to in Article 9.4 may be deducted directly from the deposit. If the deposit is insufficient, the tenant must pay the remaining amount within 7 days of the invoice date.

10. House Rules

10.1. General Conduct

  • All guests must behave respectfully towards others.
  • Aggression, intimidation, discrimination, or other inappropriate behaviour will result in removal without refund.
  • Alcohol consumption is permitted within legal limits; drug use is prohibited.

10.2. Quiet Hours and Noise

  • Quiet hours must be observed between 10:00 PM and 8:00 AM.
  • Loud music or noise that causes disturbance is not permitted.

10.3. Safety

  • Smoking and open flames are only allowed in designated areas.
  • Children must always be supervised by an adult.

10.4. Cleanliness and Environment

  • Waste must be separated and disposed of correctly.
  • Pollution or damage to the grounds or property is prohibited.

10.5. Facilities and Amenities

  • Use of facilities is at the tenant’s own risk and must be done with care.
  • The tenant is responsible for the behaviour of their children and visitors.

10.6. Consequences of Violations

  • Violating the house rules may result in removal without refund.
  • The tenant remains liable for any damage caused by themselves or by visitors.

11. Stay of Dogs

11.1. Dogs are only allowed for an additional fee in designated accommodations and must be registered at the time of booking.
11.2. A maximum of two (2) dogs per accommodation is permitted unless otherwise agreed.
11.3. Dogs must be kept on a leash at all times on the grounds of Domburg Holiday Resort.
11.4. Owners must immediately clean up and dispose of dog waste in the designated bins.
11.5. Dogs are not permitted on beds, sofas, or other furniture.
11.6. Dogs may not be left alone in the accommodation if this may lead to nuisance (e.g., barking or damage).
11.7. Fencing brought by the tenant for terrace, garden, or balcony areas is not permitted.
11.8. The tenant is fully liable for all damage and/or pollution caused by their dog(s).
11.9. If the house rules regarding dogs are not followed, Domburg Holiday Resort has the right to remove the dog and/or the tenant from the premises without refund.
11.10. Dangerous or known aggressive dog breeds may be refused by the landlord.

12.Stay of Horses

12.1. Use of Facilities

Use of the following facilities is included but may be limited due to lessons or events:

  • indoor riding arena
  • outdoor riding arena
  • sand paddock
  • horse walker
  • pasture (weather-dependent)
  • cross-country area (weather-dependent)
  • wash area

The tenant is responsible for cleaning up manure on the property and public roads (a bike with trailer is available).

12.2. Feed Supply

The landlord provides high-quality feed and ensures sufficient drinking water.
Included in the rental price:

  • up to 3 kg of concentrate feed per day (more kg at additional cost)
  • up to 10 kg dry matter of haylage or hay per day


12.3.
Care of the Horse

  • The horse will receive daily pasture time or free movement, insofar as circumstances permit.
  • The tenant is responsible for blankets and hoof care; additional services can be provided at extra cost.
  • The tenant is responsible for veterinary care, medication, worming, and vaccinations in accordance with NVWA regulations.


12.4.
Stable Cleaning and Bedding / Stable Allocation

  • The landlord performs daily mucking out and provides straw (other bedding at extra cost).
  • The landlord may allocate or change stable assignments.


12.5.
Tack Locker / Tack Room

  • Storage space is provided by the landlord.
  • The tenant is responsible for key management and any damage to the locker.


12.6.
Parking of Trailer and/or Truck

One parking space for a vehicle ≤ 3500 kg is included per stable. Additional vehicles only by arrangement and at extra cost.

12.7. External Instructors

External instructors are only permitted after consultation with the landlord.

13. Liability

13.1. Domburg Holiday Resort is not liable for loss, theft, or damage to the tenant’s personal property or pets.
13.2. Use of facilities and presence on the premises is at the tenant’s own risk.
13.3. The landlord is not liable for outages in water, gas, or electricity supplies, nor for situations of force majeure such as storms, fire, or flooding.

14. Complaints

14.1. Any complaints must be reported directly to reception during the stay so that they can be resolved appropriately.
14.2. Complaints that cannot be resolved on-site must be submitted in writing within 14 days after departure.

15. Applicable Law and Jurisdiction

15.1. All agreements are governed exclusively by Dutch law.
15.2. Disputes will be submitted exclusively to the competent court in the district of Middelburg (Zeeland).
